FENCE RULES – GERMANTOWN (CITY), TENNESSEE
OVERVIEW
Residential fences are permitted on private property within Germantown, subject to local regulations.
The City of Germantown establishes specific standards for the installation and maintenance of residential fencing to ensure community safety and the preservation of neighborhood character. These regulations address height, location, and construction quality, with distinct requirements for front yards and street-facing elevations. All new fence installations or significant modifications must undergo administrative review through a formal permitting process to verify compliance with zoning and utility access standards.
Compiled From the Germantown Code of Ordinances (Chapter 6, Section 102), the Germantown Residential Fence Information Sheet, and the Department of Economic and Community Development as of February 2026.
GOVERNANCE
Tennessee does not publish a statewide residential fence code. For properties located within Germantown city limits, residential fence standards are established and administered by the Department of Economic and Community Development, specifically through the Planning Division and the Code Compliance Division.
The primary regulatory framework is contained within Chapter 6 of the Germantown Code of Ordinances. Construction standards are further guided by the locally adopted International Residential Code (IRC), while land-use and aesthetic standards are managed by city planning staff to ensure consistency with residential zoning district requirements.
PERMIT AND APPROVAL REQUIREMENTS
A permit must be obtained from the City of Germantown prior to commencing any fence installation.
• Permit Thresholds: A permit is required for all new fences and additions to existing fences that modify the original perimeter. A permit is also mandatory for the repair or replacement of more than 50% of an existing fence or when there is a change in the location, height, fence type, or materials used.
• Application Materials: Applicants must submit a completed permit application along with a site drawing. The drawing must show the dimensions (length, width, and height) and the specific location of the proposed fence on the property.
• Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with the Planning Division before construction.
• Inspection Requirements: Permit holders are responsible for ensuring the project meets common building practices and may be subject to site inspections to verify that the fence location does not interfere with city infrastructure.
FENCE PLACEMENT RULES
• Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
• City Right-of-Way: No fence or wall may be placed within the city right-of-way, which is defined as the ten (10) foot area measured from the face of the curb toward the house.
• Easements: Fences are prohibited from preventing access to public utility or drainage easements. Fences that obstruct access to utility meters or infrastructure may be removed by the city at the owner’s expense.
• Drainage Integrity: Fence installations must allow for proper water flow. Fences must not be constructed in a manner that creates an obstruction to the natural drainage of the site or neighboring properties.
• Utility Safety: Tennessee’s Underground Utility Damage Prevention Act (TCA 65-31-101) requires everyone who digs to contact Tennessee 811 at least three (3) working days’ notice before starting a project. Tennessee 811 processes the notification of proposed excavation and notifies member utilities, or their contract locators, to mark their underground facilities prior to the excavation.
FENCE HEIGHT AND VISIBILITY RULES
• General Height Limit: The maximum allowable height for residential fences is six (6) feet.
• Front Yard Limit: Fences located in a front yard are restricted to a maximum height of 30 inches.
• Lot Type Considerations: Height and placement rules may vary based on lot type (interior, corner, or double frontage). On corner lots, specific visibility requirements apply to ensure motorist sightlines at street intersections.
• Visibility Obstructions: Fences must not be installed in a manner that impedes traffic safety or blocks the view of the street for drivers.
MATERIAL AND CONSTRUCTION LIMITS
• Permitted Materials: Acceptable materials include wood, fashioned metal (wrought iron/aluminum), decorative vinyl, and chain link.
• Orientation (Smooth Side): Wood fences that face or run parallel to a street must be installed with the “smooth” side facing the street. All structural supports, runners, and posts must be located on the side not visible from the street. This requirement does not apply to fences on a rear property line where the adjacent lot does not have a fence.
• Structural Standards: Posts should be vertical, level, and installed in concrete to a minimum depth of 18 inches. Horizontal runners must be attached with ends on the posts; “scabbing” or butting runners together between posts is not permitted.
• Prohibited Materials: The ordinance prohibits the maintenance of barbed wire, razor wire, or electric fencing on residential parcels.
PRIVATE RESTRICTIONS
HOA requirements and private covenants operate independently from City of Germantown regulations. Private rules may impose fence height, material, placement, or approval requirements that are more restrictive than City standards. City approval or the lack of a permit requirement does not override private restrictions.
REVIEW AND ENFORCEMENT CONTEXT
Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:
• Unpermitted Work: Installing a new fence or replacing a significant portion of an existing fence without an approved permit from Economic and Community Development.
• Encroachment: Placement of a fence within the 10-foot city right-of-way or blocking a recorded drainage or utility easement.
• Orientation Violations: Installing a street-facing wood fence with structural bracing or “ribs” facing toward the public street.
• Height Non-Compliance: Construction of a fence exceeding the 6-foot city maximum or the 30-inch front yard limit.
• Visibility Hazards: Fences on corner lots that obstruct the line of sight for motorists at intersections.
